Muze Women Community Ride Waiver, Risk Acknowledgement, and Release Agreement
- Participation in Muze Women Rides
- Compliance with Terms: By participating in any community ride ("Ride") organized by Muze Women and / or Muze Women Ride Captains (individually and collectively referred to as "Muze"), you agree to be bound by the terms and conditions set forth in this Waiver, Risk Acknowledgement, and Release Agreement ("Agreement"). Participation in any Ride is conditional upon your acceptance of these terms, including the insurance requirements specified herein. IF YOU DO NOT AGREE TO THESE TERMS YOU CANNOT PARTICIPATE IN ANY MUZE RIDE AND IF YOU DO NOT ADHERE TO THESE TERMS< MUZE HAS THE AUTHORITY TO END YOUR PARTICIPATION IN THAT RIDE OR FUTURE RIDES.
- Insurance Requirement: YOU ARE REQUIRED TO HAVE ACTIVE PERSONAL LIABILITY INSURANCE COVERAGE TO PARTICIPATE IN ANY RIDE. ACCEPTABLE PROVIDERS INCLUDE AUSCYCLING, BICYCLE NSW, BICYCLE NETWORK OR TRIATHLON AUSTRALIA. Proof of insurance must be presented upon registration and must cover any incidents that may occur during a Ride
- Rider and Bike: You are solely responsible to ensure that you have the correct skills, experience, preparation and equipment to participate in a Muze Ride.
- You must be over 18, carry a mobile phone and identification.
- You have the skills, competence, experience and fitness to participate in that Muze Ride.
- You must have a road legal, well-maintained bike with working brakes, front and back lights and you can complete basic repairs to your bike unassisted.
- You must be self-sustained for the ride with water, food and toolkit.
- Acknowledgement of Risks
- Risks Involved: You acknowledge that cycling is an inherently dangerous activity that may result in serious injury, death, or property damage. Risks include, but are not limited to, those caused by terrain, facilities, temperature, weather, condition of participants, equipment, vehicular traffic, and actions of other people.
- Assumption of Risk: You voluntarily assume all risks, both known and unknown, associated with your participation in Rides, even if arising from the negligence of the releases or others, and assume full responsibility for your participation. You have sole responsibility for your personal safety and possessions. You will be personally responsible for any fees or costs incurred or arising from an accident either involving or caused by you.
- Release and Indemnity
- Release of Liability: You hereby release, waive, discharge, and covenant not to sue Muze, its directors, officers, employees, volunteers, agents, and sponsors from any and all liability to you for any loss or damage, and any claim or demands therefore on account of injury to your person or property or resulting in your death arising out of or related to your participation in any Ride, whether caused by the negligence of Muze or otherwise.
- Indemnity: You agree to indemnify and hold harmless Muze from all liabilities or claims made as a result of your participation in a Ride, whether caused by you or otherwise.
- Medical Considerations
- You affirm that you are medically capable of participating and that you have either secured a medical clearance or decided to participate without such assurance at your own risk.
- I hereby consent to receive medical treatment which may be deemed advisable in the event of injury, accident or illness during an event.
- Additional Agreements
- Behaviour and Conduct: You agree to abide by the rules and safety guidelines of Muze and the bicycle laws of the state you are riding in. You must obey ride captain direction and conduct yourself in a manner that does not bring disrepute to the organisation or endanger other participants.
- Environmental Responsibility: You commit to not littering and to respecting the natural and urban environments traversed during the Ride.
- Privacy: Muze collects, holds and uses your personal information in accordance with its privacy policy which can be found here: Muze Women Privacy Policy.
- General Provisions
- Governing Law: This Agreement shall be governed by and interpreted in accordance with the laws of the state or territory in which the Ride takes place.
- Severability: If any provision of this Agreement is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions.
